In short
- PickleBoard is run by iCTO U.K. Ltd in England. These terms are the agreement between you and us.
- Tournament results and player names are public by design: they appear on scoreboards, brackets, broadcasts and leaderboards.
- Organisations (tournament organisers and clubs) are responsible for their events, their members and the data they enter. For that data, we act as their processor (section 7).
- When a club takes payments, the club is the seller and Stripe processes the payment. PickleBoard isn't a party to that sale.
- Follow the Acceptable Use Policy. In particular, don't manipulate results, ratings or rankings.
- If you're a consumer, nothing here takes away your legal rights.
This summary is for convenience. The numbered sections below are the binding terms.
1About these terms
These Terms of Service (the “Terms”) govern your use of PickleBoard. PickleBoard is a live pickleball platform for tournaments, clubs, coaching and community. It covers the PickleBoard website and web app, the PickleBoard mobile apps, and our downloadable software, including the Pickle Engine and PB Tracker. It also covers the PickleBoard Community, the Knowledge Base and every other module (together, the “Platform”).
PickleBoard is a trading name of iCTO U.K. Ltd (“we”, “us”, “our”), a company registered in England and Wales under company number 10743843, with its registered office at Archer House, Britland Estate, Northbourne Road, Eastbourne, BN22 8PW. You can contact us at privacy@pickleboard.app.
By creating an account, ticking the box at sign-up, installing one of our apps, or otherwise using the Platform, you agree to these Terms. The following also form part of them:
- our Acceptable Use Policy, which sets out what you may and may not do on the Platform;
- our Cookie Policy;
- our Privacy Policy, which explains how we handle personal data (it is a notice, not a contract term).
If you don't agree, please don't use the Platform. Some public pages can be viewed without an account, such as these legal pages, our marketing pages and broadcast overlays. Sections 10 to 21 still apply to that use.
2Key terms
- Account: your personal PickleBoard sign-in. One person has one Account.
- Organisation: a tenant on the Platform, such as a tournament organiser, a venue, a league or a club. Each Organisation has its own events, members, settings and plan.
- Organisation Admin: a person who creates an Organisation, or is given an administrative role in one.
- Customer: an Organisation that uses the Platform, on a free or paid plan.
- Member: a person who belongs to an Organisation, for example a club member, player, coach, referee or crew member.
- Match Data: competition data such as draws, entries, team and player names as entered, scores, results, timings, statistics, standings, ratings and rankings.
- Content: anything a user adds to the Platform, including text, posts, comments, messages, photos, logos, audio, reviews, articles and lesson feedback.
- Software: the PickleBoard mobile apps, the Pickle Engine, PB Tracker and any other software we let you download or install.
3Who can use PickleBoard
- You must be at least 13 to create an Account. If you are under 18, a parent or guardian must agree to these Terms for you and supervise your use. A club or coach working with junior players must have the consents the law requires; see the safeguarding rules.
- If you create or administer an Organisation, you confirm that you have authority to bind that Organisation to these Terms. In that case, “you” includes the Organisation.
- You may not use the Platform if we have previously suspended or removed you, or if the law prohibits it.
4Your account and security
- Give accurate information and keep it up to date. Your name and DUPR ID are used to match you to tournament records. Your profile is managed on My Profile.
- Keep your password, passkeys and devices secure, and don't share your Account. Tell us straight away at privacy@pickleboard.app if you think someone else has accessed it.
- Credentials and tokens. Some features use credentials other than your password, for example API keys, service accounts, Stream Deck accounts, paired scoring tablets and Pickle Engine or PB Tracker pairing tokens. These are confidential. The Organisation that issued them is responsible for what is done with them, and must revoke any that are lost.
- You are responsible for activity under your Account and under credentials your Organisation issues, unless it results from our breach of these Terms.
- We keep an audit log of significant actions, such as score changes, role changes and access to protected personal details. This is for security and to resolve disputes, as described in our Privacy Policy.
5Organisations, roles and responsibilities
The Platform is shared by many Organisations, and each one is kept separate from the others. If you run an Organisation:
- You decide who joins it and what role each person has, for example Full Admin, Club Admin, Coach, scorer or referee. You are responsible for granting and removing access appropriately.
- You are responsible for your events and activities: the rules, formats, scheduling, officiating, venue safety, insurance, entry and refund policies, prizes, and any decisions on results or disputes. PickleBoard provides the software; we are not the organiser of your event.
- You are responsible for the lawfulness of the personal data you put onto the Platform. This includes rosters, imported player lists, club members, contact details, photographs and anything you broadcast. You must have a lawful basis and give people any notices the law requires (see section 7).
- You decide whether your events are published. Once you publish a tournament, its Match Data can be viewed by others, including people outside your Organisation (see section 9).
- You can enable or disable modules for your Organisation. Disabling a module hides it but does not delete its data.
6Plans, fees and billing
6.1 Plans
Organisations can use the free Starter edition or a paid edition. The paid editions are Club, Essentials, Essentials with the Club add-on, Professional and Enterprise. Each one unlocks the features and limits described on our Compare editions page when you subscribe. Player, spectator and Community accounts are free.
6.2 Payment
- Paid plans are subscriptions billed in advance, through our payment processor Stripe, at the price shown at checkout (plus VAT or other taxes where applicable). They renew automatically at the end of each billing period until cancelled.
- You can cancel at any time from the billing portal on your plan page. Cancellation takes effect at the end of the current billing period. Except as set out in section 6.4 or where the law requires, we don't refund partial periods.
- If a payment fails, your subscription becomes past due. We keep your paid features for a 30-day grace period while Stripe retries the payment. If it still hasn't been paid, your Organisation moves to the Starter edition. Your data is kept, but features and limits outside Starter stop working, for example extra active events or courts. Nothing is deleted because of a downgrade.
- We may change prices. We will give you at least 30 days’ notice by email or in the Platform before a price change applies to your subscription, and you can cancel before it takes effect.
- From time to time we may offer complimentary, promotional or legacy plans. These last for the period we state. If no period is stated, we may end them with 30 days’ notice.
6.3 Consumers: your 14-day right to cancel
If you buy a paid plan as a consumer (for purposes outside your trade, business, craft or profession), you can cancel within 14 days of purchase without giving a reason. To cancel, email privacy@pickleboard.app or use the billing portal. Because the service starts as soon as you subscribe, we may deduct a proportionate amount for the days you used it before cancelling. We will refund the rest within 14 days using your original payment method.
6.4 Organisations buying as a business
If you subscribe as a business, section 6.3 does not apply. Fees are non-refundable except where these Terms or the law say otherwise.
7Personal data and data protection
Our Privacy Policy explains how we use personal data as a controller. This covers your Account, security and audit logs, platform-wide rankings, the Community and our own communications.
Where an Organisation enters or manages personal data about its own people (rosters, club members, session bookings, coaching records, payment records and similar), the Organisation is the controller and we process that data as its processor. The Data Processing Terms in section 22 apply to that processing. They form part of these Terms for every Organisation.
8Club payments (Stripe Connect)
A club can connect its own Stripe account to collect membership dues, session fees and guest fees from its members. When it does:
- The club is the seller. Your contract for membership or a session is with the club, not with PickleBoard. Prices, inclusions, cancellations, refunds, credits and complimentary places are set by the club and are the club’s responsibility.
- Payments are processed by Stripe on the club’s Stripe account, under Stripe’s terms (including the Stripe Connected Account Agreement). Card details are entered on Stripe’s pages; we never see or store full card numbers.
- We may charge the club a platform fee on these payments. If we do, the club will be told the rate before it is applied.
- Clubs must comply with consumer law when selling to their members, including giving clear pre-contract information and honouring cancellation rights. Questions about a charge, a refund or a chargeback should go to the club first.
9Match data, broadcasts, ratings and rankings
- Public by design. Competing in an event run on PickleBoard means your name (as entered by the organiser), team, results and statistics may appear on live scoreboards, brackets and standings. They may also appear on OBS broadcast overlays, venue screens, live streams, highlight reels, leaderboards, recaps and certificates, including on published pages anyone can view. Match records stay part of the competition record after an event (see the Privacy Policy).
- Filming and streaming. An Organisation that films, records, streams or uploads footage (including through YouTube or the Pickle Engine) must have the rights and permissions needed. This includes giving participants and spectators suitable notice, and getting consent where the law requires, especially for children.
- Ratings and rankings. PickleBoard calculates skill ratings within each Organisation and platform-wide PickleBoard rankings. These are estimates calculated automatically from recorded results under published rules. They are not a guarantee of ability, and we may recalculate, correct or reset them. For example, we may do so when a result is corrected or an event is reset, or when we find manipulation contrary to the Acceptable Use Policy. DUPR ratings belong to DUPR and are governed by DUPR’s own terms.
- Accuracy. Scores are entered by people (organisers, referees, players at a kiosk) and by connected devices. We work to show results accurately and in real time, but the Organisation running the event is responsible for the official result.
10Your content
- You own your Content. You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, display, adapt (for example, resize or transcode), broadcast and distribute it. That licence is only for operating, securing and improving the Platform, and for showing it to the audience you chose (for example, your Organisation, a group, a hub or the public). For Community Content, the licence ends when you delete it, except for copies others have shared, copies we must keep by law, and backups that cycle out in the normal course. For Match Data, it continues as part of the competition record.
- You confirm that you have the rights to everything you upload. This includes logos, sponsor artwork, photos, stinger and backing-track audio, and video. You also confirm that it doesn't infringe anyone’s rights or break the law. Music used in broadcasts or highlight reels usually needs a licence.
- We don't screen Content before it is posted and we don't use automated content moderation. We may review, restrict or remove Content, and act against accounts, as set out in the Acceptable Use Policy.
- Reviews of coaches and venues must reflect a genuine experience. We remove reviews we believe are fake or incentivised without disclosure.
- If you think Content infringes your copyright or other rights, email privacy@pickleboard.app with details. Include the work, where the Content is, and your contact details. We will act promptly.
11The Community, coaching and the Knowledge Base
- Community features let you post, comment, follow, message, join groups and club or tournament hubs, and find players, games and venues nearby. What you share is visible to the audience you choose. Location-based features are opt-in. Other players see only an approximate area, never your precise location.
- Coaches listed on the Platform are independent of PickleBoard. We don't employ, vet or endorse them, and arrangements you make with a coach or club are between you and them. Clubs are responsible for the suitability and safeguarding checks of the coaches they list.
- The Knowledge Base and the PickleBoard Academy provide general information about pickleball. They are not personal coaching, medical or physiotherapy advice. Academy materials are licensed to you only for your personal training, or for your club’s coaching programme on PickleBoard, and may not be republished.
12Health and safety
Pickleball is a physical sport and carries a risk of injury. You take part in events, sessions, games you arrange through Find & Play, and drills from the Academy or Knowledge Base at your own risk and within your own fitness. Stop and seek advice if you feel unwell. The organiser or club running an activity is responsible for the venue, equipment and supervision. Nothing in this section limits liability that cannot be limited by law (see section 19).
13Licence to use our apps and software (EULA)
This section is the end-user licence agreement for our Software. Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the Software. You may use it only to access and use the Platform as these Terms allow: on devices you own or control, for the mobile apps; on machines your Organisation operates, for the Pickle Engine and PB Tracker.
You must not, except as far as the law expressly permits:
- copy, modify, translate or create derivative works of the Software;
- decompile, disassemble or reverse engineer it, or attempt to derive its source code;
- rent, lend, sell, sublicense or distribute it, or remove any proprietary notices;
- use it to build a competing product, or to get around security or the plan limits in section 6.
- Updates. We may update the Software, including automatically. For example, the Pickle Engine updates itself on managed installs. Some updates may be needed to keep using the Platform.
- Pickle Engine. It connects outbound to the Platform and carries out instructions your operators send, such as switching OBS scenes, saving replays and assembling highlight reels, on the machine where you install it. You are responsible for that machine, for your OBS configuration and for the footage it handles.
- PB Tracker. It processes camera video on your own machine and sends only derived statistics (such as heat-maps and movement data) to the Platform, not video frames. The one exception is a single calibration still, which an operator requests and which is held briefly so the court can be set up. You must have the right to film the people it tracks and must give them suitable notice.
- Open-source components. The Software includes open-source components licensed under their own terms. Nothing in these Terms limits your rights under those licences.
- The licence ends when these Terms end or when you stop using the Platform. You must then delete the Software.
14Apps from the Apple App Store and Google Play
If you get our mobile app from the Apple App Store or Google Play, the following also applies:
- These Terms are between you and us only, not with Apple Inc. or Google LLC (“the App Store provider”). We, not the App Store provider, are responsible for the app and its content.
- Your licence to use the app is limited to use on Apple-branded devices you own or control (or Android devices, for Google Play), as permitted by the App Store provider’s usage rules. Family Sharing or similar arrangements may also apply where enabled.
- We are solely responsible for maintenance and support. The App Store provider has no obligation to provide any.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the maximum extent permitted by law, the App Store provider has no other warranty obligation. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are our responsibility, to the extent these Terms make them so.
- We, not the App Store provider, are responsible for any claims relating to the app or your use of it. These include product liability claims, claims that the app fails to meet legal or regulatory requirements, and consumer-protection, privacy or similar claims.
- If a third party claims that the app or your use of it infringes their intellectual property rights, we, not the App Store provider, are responsible for investigating, defending, settling and discharging that claim.
- You confirm that you are not located in a country subject to a UK, EU or US government embargo or designated as supporting terrorism, and that you are not on any UK, EU or US list of prohibited or restricted parties.
- You must comply with any third-party terms that apply when you use the app, for example your mobile network’s terms.
- Apple and its subsidiaries (or Google, as applicable) are third-party beneficiaries of this section and may enforce it against you.
- Questions, complaints or claims about the app go to us: iCTO U.K. Ltd, Archer House, Britland Estate, Northbourne Road, Eastbourne, BN22 8PW, privacy@pickleboard.app.
15Our intellectual property
We and our licensors own the Platform and the Software, including the PickleBoard name and logo, the design, code, overlays, themes, diagrams, Knowledge Base articles we publish and Academy materials. Except for the licences in these Terms, we don't grant you any rights in them. If you send us feedback or suggestions, we may use them freely and without any obligation to you.
16Third-party services
The Platform connects to services run by others. These include Stripe (payments), DUPR (ratings), YouTube (live streams and uploads), Google Maps, OBS Studio, Apple and Google (app distribution and push notifications), and email providers. Your use of those services is governed by their own terms and privacy policies. We aren't responsible for them, or for any change that affects how they work with PickleBoard.
17Availability and changes to the Platform
- We aim to keep the Platform available and working, especially during live events, but we don't guarantee uninterrupted or error-free service. We may carry out maintenance, which we will try to schedule away from busy event times where we can.
- We may change, add or remove features. If we remove a feature that is a material part of a paid plan you have already paid for, we will tell you in advance. If the change is significantly to your disadvantage, you may cancel and receive a pro-rata refund for the unused period.
- Features marked beta or preview are provided to try out and may change or be withdrawn.
- Keep your own copies of anything critical. Organisations can download reports, exports and match history from the Platform.
18Suspension and ending these Terms
- You can stop using the Platform at any time and delete your Account from My Profile. An Organisation Admin can close their Organisation. Paid subscriptions should be cancelled through the billing portal.
- We may suspend or close an Account or an Organisation if: you seriously or repeatedly break these Terms or the Acceptable Use Policy; payment remains overdue after the grace period in section 6.2; we must do so by law; or your use puts the Platform, other users or us at risk. Where reasonable, we will warn you first and explain why. You can ask us to review the decision (see the appeals process).
- We may stop providing the Platform altogether by giving at least 90 days’ notice. We will refund any fees you have prepaid for the period after it ends.
- When these Terms end, your right to use the Platform and the Software ends. We will delete or de-identify personal data as described in the Privacy Policy and section 22. Match Data stays in the competition record without being linked to an identifiable Account. Sections 7, 10, 15, 19, 20, 22 and 24 continue to apply.
19Our liability to you
19.1 Everyone
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law.
19.2 If you are a consumer
- We provide the Platform with reasonable care and skill, and the digital content we supply will be as described and of satisfactory quality. These are your statutory rights under the Consumer Rights Act 2015. Citizens Advice can give you more information.
- We are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable.
- We provide the Platform for domestic and private use. We are not liable for any loss of profit, loss of business, business interruption or loss of business opportunity.
- If digital content we supply damages a device or other digital content you own because we did not use reasonable care and skill, we will either repair the damage or pay you compensation.
19.3 If you are an Organisation or using the Platform for business
- Except as set out in these Terms, the Platform is provided “as is” and “as available”. To the extent the law allows, all implied terms, warranties and conditions are excluded.
- We are not liable for: loss of profits, revenue, sales, business or goodwill; loss of anticipated savings; loss or corruption of data where you could have kept your own copy; or any indirect or consequential loss.
- Our total liability to you, in contract, tort (including negligence), breach of statutory duty or otherwise, for all claims arising in any 12-month period is limited to the greater of (a) the fees you paid us for the Platform in the 12 months before the event giving rise to the claim, and (b) £100.
20Indemnity (Organisations only)
If you use the Platform as an Organisation, you will reimburse us for reasonable losses, costs and expenses (including legal fees) arising from a third-party claim. This applies where the claim results from: Content or personal data your Organisation put on the Platform; your events and activities; your club’s sales to its members; or your breach of these Terms or the law. We will tell you about such a claim promptly and let you take part in its defence.
21Changes to these Terms
We may update these Terms, for example to reflect new features or changes in the law. For material changes, we will notify you by email or in the Platform at least 30 days before they take effect, unless a change is needed sooner for legal or security reasons. If you don't agree to a change, you can stop using the Platform and cancel any subscription before the change takes effect. If you are a consumer, you are entitled to a pro-rata refund of any fees you have prepaid. The version and effective date at the top of this page show which version applies.
22Data Processing Terms (for Organisations)
These terms meet the requirements of Article 28 of the UK GDPR and the EU GDPR. They apply when we process personal data on behalf of an Organisation (the “controller”) as its processor.
- Subject matter and duration. Hosting and operating the Platform for the Organisation for as long as it uses the Platform, and for the deletion period afterwards.
- Nature and purpose. Storing, organising, displaying, broadcasting, transmitting and otherwise processing data to run the Organisation’s tournaments, clubs, coaching, payments and communications, as configured by the Organisation.
- Types of personal data. Names, contact details, DUPR IDs and ratings, profile details, membership and booking records, attendance, payment records (not card numbers), coaching progress and feedback, messages and announcements, Match Data, images and audio-visual content, and the derived movement statistics from PB Tracker.
- Data subjects. The Organisation’s members, players, entrants, guests, coaches, staff, officials and volunteers, and spectators or venue visitors captured in footage.
- Instructions. We process the data only on the Organisation’s documented instructions. These Terms and the Organisation’s use and configuration of the Platform are those instructions. We do not follow them where the law requires otherwise; in that case we will tell the Organisation, unless the law prohibits it. We will tell the Organisation if we believe an instruction breaks data-protection law.
- Confidentiality. Everyone we authorise to process the data is bound by a duty of confidentiality.
- Security. We maintain appropriate technical and organisational measures. These include encryption in transit (HTTPS), salted password hashing, role-based access control with separation between Organisations, audit logging of access to protected personal details, and controlled administrative access.
- Sub-processors. The Organisation authorises our current sub-processors, listed below. We will give at least 30 days’ notice of a new sub-processor; the Organisation may object on reasonable data-protection grounds. If we can't resolve the objection, the Organisation may end the affected service and receive a pro-rata refund. We impose data-protection obligations on each sub-processor equivalent to these, and remain responsible for them.
- Assistance. Taking into account the nature of the processing, we will help the Organisation respond to requests from data subjects exercising their rights; much of this is self-service in the Platform. We will also help it meet its obligations on security, breach notification, impact assessments and prior consultation.
- Personal data breaches. We will notify the Organisation without undue delay after becoming aware of a breach affecting its data, with the information it reasonably needs to meet its own obligations.
- Deletion or return. When the Organisation stops using the Platform, it can export its data. We will then delete or de-identify the personal data within a reasonable period, unless the law requires us to keep it. Match Data in the competition record is kept in de-identified form.
- Audit. We will make available the information reasonably needed to show compliance with this section, and allow for and contribute to reasonable audits, on reasonable notice and subject to confidentiality.
- International transfers. Where data is transferred outside the UK or EEA, we rely on adequacy regulations or decisions, or on appropriate safeguards such as the UK International Data Transfer Agreement or Addendum and the EU Standard Contractual Clauses.
| Sub-processor | What they do | When it applies |
|---|---|---|
| Render Services, Inc. | Cloud hosting and storage for the Platform and its databases | Always |
| Twilio SendGrid | Sending account, club and notification emails | When email is used |
| Stripe Payments UK, Ltd. (and Stripe affiliates) | Subscription billing, and club payments on the club’s own Stripe account | When payments are used |
| Apple Inc. / Google LLC | Delivering push notifications to iOS and Android devices | When a member turns on notifications |
| Freshworks Inc. (EU data centre) | Our service desk: support requests that need a person are copied there as tickets, with personal details removed from what people wrote, so our team can answer them | When we switch the service desk link on |
| Cloudflare, Inc. (EU jurisdiction) | Storing uploaded files in the EU: organisation logos and covers, sponsor and theme logos, pictures in published articles, member profile photos and sting audio. Member photos and audio are shown only through short-lived links after a permission check | When we move uploaded files there |
| Anthropic, PBC | The support agent: suggesting fixes from support case outlines that hold codes, states and stand-in identifiers only, never names, contact details, real identifiers or anything people wrote | When we switch the support agent on |
23Complaints and disputes
If you have a complaint, please contact us first at privacy@pickleboard.app. We will acknowledge it and aim to resolve it within 30 days. Complaints about Content or another user’s behaviour follow the reporting process in the Acceptable Use Policy. Privacy complaints can also go to the UK Information Commissioner’s Office.
24General
- Entire agreement. These Terms, together with the documents they refer to and any order form we sign with an Enterprise customer, are the whole agreement between us about the Platform. If an Enterprise order form conflicts with these Terms, the order form wins.
- Transfer. We may transfer our rights and obligations to another organisation, for example as part of a sale of our business. We will make sure this doesn't reduce your rights. You may not transfer yours without our written consent.
- Events outside our control. We are not responsible for delays or failures caused by events beyond our reasonable control. These include failures of hosting, internet or third-party services, and venue power or network outages.
- Severability. If a court finds part of these Terms invalid, the rest stays in force.
- No waiver. If we delay enforcing these Terms, we can still enforce them later.
- Third-party rights. Apart from section 14, no one other than you and us has any right to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999.
- Notices. We may send you notices by email to your Account address or through the Platform. You can send notices to privacy@pickleboard.app.
- Governing law and courts. These Terms are governed by the law of England and Wales. Disputes go to the courts of England and Wales. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your local courts. If you are a consumer living elsewhere in the UK or EU, you keep the protection of any mandatory consumer law where you live.
